Welcome to Xquizit ("we," "us," or "our"). These Terms and Conditions govern your access to and use of our AI-powered hiring assessment platform, including our website, desktop applications, and related services (collectively, the "Platform").

By registering an account, purchasing a subscription, or participating in an assessment, you agree to be bound by these Terms. If you do not agree, you may not access or use the Platform.

To use certain features of the Platform, you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

You are responsible for safeguarding your login credentials. You may not share your account with any other person or entity. You are fully responsible for all activities that occur under your account. If you suspect unauthorized use, you must notify us immediately.

If you are a candidate taking an assessment via our Platform, you agree to adhere to strict rules of academic and professional honesty. You must complete all tests and interviews independently, without assistance from unauthorized persons, external websites, or software tools.

AI Proctoring and Monitoring

To maintain test integrity, the Platform utilizes active proctoring mechanisms. By starting an assessment, you consent to the continuous recording of your webcam, microphone, and screen activity for the duration of the session. You also consent to the use of AI algorithms to analyze this data to detect potential misconduct.

Consequences of Violation

Any attempt to manipulate the platform, bypass proctoring controls, or engage in dishonest behavior will result in the immediate termination of the assessment and the reporting of your conduct to the hiring organization. The hiring organization retains the right to disqualify your candidacy based on our proctoring reports.

Platform Ownership

The Platform, including its underlying technology, software, algorithms, design, text, graphics, and trademarks, is the exclusive property of Xquizit and its licensors. You are granted a limited, non-exclusive, non-transferable license to access and use the Platform in accordance with these Terms.

Customer Data

Hiring organizations retain ownership of the data they input into the Platform, including custom questions and rubrics. By using the Platform, you grant Xquizit a license to host, process, and analyze this data solely to provide and improve the services.

Certain features of the Platform are available on a subscription or pay-per-use basis. By selecting a paid service, you agree to pay the specified fees.

Billing and Taxes

• Advance Billing: Fees are billed in advance on a recurring basis or at the time of purchase for one-off usage tokens.
• Payment Processors: We use third-party payment processors (such as Razorpay) to handle transactions securely. You agree to their respective terms and privacy policies when making a payment.
• Taxes: Fees are exclusive of applicable taxes, which will be calculated and added to your invoice based on your billing location.

Refund Policy

No Refunds: All purchases, including subscription fees and one-off usage tokens, are final and strictly non-refundable. We do not provide refunds, partial refunds, or credits for any partially used subscription periods, unused tokens, or accidental purchases under any circumstances.

Cancellation Policy

You may cancel your recurring subscription at any time through your account settings or by contacting support. Please note the following regarding cancellations:

• End of Billing Cycle: Your cancellation will take effect at the end of your current paid billing cycle. You will continue to have access to your subscription features until that cycle concludes. You will continue to have access to your unused tokens until they last.
• Purchasing Additional Credits: Upon cancellation, you will be prevented from loading or purchasing additional usage credits without first reactivating or purchasing a new active subscription.

The Platform is provided on an "AS-IS" and "AS-AVAILABLE" basis. Xquizit expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Platform will be uninterrupted, error-free, or entirely secure, or that the AI-generated evaluations are flawless. AI assessments are designed to assist hiring decisions but should not be the sole determining factor in employment.

To the maximum extent permitted by applicable law, in no event shall Xquizit, its directors, employees, or partners be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of your use or inability to use the Platform.

Our total liability for any claims arising under these Terms shall not exceed the amount you paid us for the services in the twelve (12) months preceding the claim.

We reserve the right to suspend or terminate your account and access to the Platform at our sole discretion, without notice or liability, for any reason, including but not limited to a breach of these Terms. Upon termination, your right to use the Platform will immediately cease.

We may modify these Terms at any time. We will provide notice of material changes by updating the "Last updated" date on this page or by sending an email to the address associated with your account. Your continued use of the Platform after the changes become effective constitutes your acceptance of the new Terms.
